Child entrustment

If, for serious reasons, the parent cannot provide personal care of their under-aged child or if the child´s  raising has been seriously endangered or impaired, the court can entrust the child in substitute personal or tutor´s care. If entrustment in substitute personal or tutor´s care isn´t possible, the court can order the institutional care.  

Competent staff of the Department of Social-Legal Protection of Children and Social Curatorship will provide you with consultations and assistance.  

The state supports substitute care of a child with contributions – social allowances – provided that the care of a child is provided in person based on the court decision. 

Substitute care of a child refers to:

a)     entrustment of an under-aged child to personal care of other physical individual than           his parent, 

b)     tutor care,

c)      fosterer care if the fosterer takes care of a child in person. This doesn´t apply if the             fosterer takes care of a child in person, whose parents aren´t adult,  

d)     temporary entrustment of a child in the care of a person interested in becoming    
        a fosterer, 

e)     entrustment of a child in the care of a physical individual through the court decision on         ordered preliminary injunction, provided that the court received proposal for
        commencement of court proceedings related to entrustment of the child in the care of           this physical individual (personal/ tutor care of a child).

g)      entrustment of an under-aged child to care before adoption

f)       entrustment of a child in the care of a physical individual by preliminary injunction, if             the court is adjudicating in issue of care before adoption.
